Terms of Sale
1. Seller and scope
The seller and contracting party for purchases made through the KnowDrugs Merchandise shop is Plant Product Design UG (haftungsbeschränkt), Mahlower Str. 24, 12049 Berlin, Germany (register court: Amtsgericht Charlottenburg, HRB 203638 B, VAT ID DE322831923). These Terms apply to consumer orders placed through our online shop at shop.knowdrugs.app.
2. Ordering and formation of the contract
The presentation of products in the online shop does not itself constitute a binding offer. By clicking the final button that places the order and creates a payment obligation, you submit a binding offer to purchase the goods in your cart.
After you submit the order, you receive an electronic confirmation that we have received it. This automated receipt confirmation does not by itself constitute acceptance of your offer unless it expressly states otherwise. We accept your offer when we send a separate acceptance or shipping confirmation, or when we dispatch the goods, whichever occurs first.
If we do not accept an order, any payment already collected for that order will be reimbursed without undue delay.
3. Technical steps, correction of input errors and contract text
To place an order, you select the desired product and variant, add it to the cart, proceed through checkout, enter or confirm the requested contact, delivery and payment information, review the order information provided by Shopify, and then use the final order button to submit the order.
Before submitting the order, you can identify and correct input errors using the cart and checkout controls, including changing quantities, variants, addresses and other information where the checkout permits this.
We store the order and contract data to the extent necessary to process the transaction and comply with applicable legal obligations. After ordering, you receive an order confirmation by email. Where customer-account functionality is available, order information may also be accessible through your customer account or order-status page. The contractual terms and policies can be accessed and saved in reproducible form when the contract is concluded.
We are not currently subject to any special code of conduct within the meaning of the statutory e-commerce information duties.
4. Contract languages
The contract can be concluded in the language offered to you in the storefront and checkout. At present the published storefront language is English. German will also be available once the German storefront is published.
5. Prices and shipping charges
Final prices displayed for the relevant market include applicable taxes to the extent required by the rules applicable to the order. Any additional shipping charges are shown before the order is submitted.
6. Payment
The payment methods available for an order are those shown in checkout. Payment processing may be carried out through Shopify and the payment provider selected by the customer.
7. Production, shipping and delivery
Most merchandise is produced after an order is placed by a third-party print-on-demand fulfilment provider and then shipped to the customer. This production method does not limit statutory consumer rights.
Production and delivery times displayed in the shop, checkout or shipping communications are estimates unless a date is expressly stated to be binding. Statutory rights relating to delayed delivery remain unaffected.
8. Right of withdrawal
Consumers entering into distance contracts generally have a statutory right of withdrawal. Full information is provided in our Refund / Withdrawal Policy and on the Withdrawal page.
Some standard catalogue products are produced only after ordering. For the fixed-design standard products currently offered, production after ordering does not by itself exclude the statutory right of withdrawal. Statutory exceptions may apply where a product is genuinely made to individual consumer specifications, clearly personalised, or otherwise covered by a statutory exception; where relevant, this will be indicated for the affected product.
9. Statutory conformity and defect rights
Statutory rights apply if goods are defective or otherwise not in conformity with the contract. Please contact shop@knowdrugs.app if there is a problem. Providing an order number and photographs can help us resolve a claim efficiently but does not replace or exclude statutory rights.
Internal claim deadlines imposed on us by a fulfilment provider do not shorten the consumer's statutory rights against us as seller.
10. Retention of title
Goods remain our property until they have been paid for in full.
11. Applicable law
German law applies. For consumers habitually resident in another country, this choice of law does not deprive the consumer of protection afforded by mandatory provisions of the law that would apply in the absence of this choice under the applicable conflict-of-law rules, in particular Article 6 of Regulation (EC) No 593/2008 (Rome I).
